TERMS AND CONDITIONS (“Contest Rules”)
1.DESCRIPTION OF DRAW
Norton Embracing Educational Development, Inc (“NEED”) or its designated representative will conduct a Dinner Anywhere in the World Raffle (“Raffle”) for the purpose of fundraising for the educational organization NEED, which services the public benefit of Norton Public Schools. The raffle is a stub draw for three prizes: 1. Dinner for Two Anywhere in the World; 2. A $250 Marriott gift card; 3. A $50 Mac & Walt’s gift card. The prizes are referenced on the ticket. Tickets will be available for purchase from Wednesday, August 28, 2019 until 8:00pm Friday, April 3, 2020, unless all tickets are sold sooner.
2.HOW TO ENTER
Upon purchasing a ticket(s), the purchaser shall retain the paper ticket portion and the stub portion shall be placed into the ballot container located at a NEED officer’s home, by a NEED staff/representative. Each ticket must list the purchaser’s name, address, telephone number, and e-mail address. The ticket and stub should be signed by the purchaser for record-keeping purposes. All stubs must be received by 8:15pm on Friday, April 3, 2020 for the 9:15pm Draw Time at the location of the draw. The drawing will take place at Raynham Park, located at 1958 Broadway, Raynham, MA during NEED’s 2nd Annual Comedy Night Fundraiser on Friday, April 3, 2020.
In order to participate in this draw, a person must not be otherwise excluded from the Raffle pursuant to the restrictions described in Section 7.1 of the Rules of Draw herein. Entrants must present acceptable identification upon request (see Section 6 herein).
NEED takes no responsibility for lost, delayed, stolen, destroyed or misdirected tickets, as more fully described in section 7.5(c) herein.
3.PRIZE DRAW DATE
The Draw shall be held on Friday, April 3, 2020 at 9:15 pm ET (“Draw Time”) at Raynham Park, located at 1958 Broadway, Raynham, MA during NEED’s 2nd Annual Comedy Night Fundraiser (“Draw Site”), at which time a NEED volunteer representative will randomly draw three (3) stubs from the ballot container, located at the Draw Site. The selected entrant need not be present to win.
The winners of the prizes shall be determined by reference to the Name, Address, Telephone Number, and e-mail on the stub(s) drawn. The selected entrant will be announced at the Draw Site and will be publicized on the NEED website and on all social media sites/pages/accounts administered by NEED.
A news release shall be sent out and the coverage received via this media release shall also reflect further announcements of the selected entrants. (See Section 7.3 herein regarding Privacy/Use of Personal Information.) If the selected entrant is not present, he/she will be notified by telephone and/or e-mail as provided on their ticket stub no later than April 6, 2020.
4.PRIZES
Prize(s) shall be accepted as awarded on the draw date. No cash option will be offered for any of the prizes. Prizes are limited to those items explicitly set forth herein and any and all other expenses not provided for shall be the sole responsibility of the selected entrant. Substitution or modifications of the prize shall not be permitted. The decision of NEED shall be final on all matters concerning the raffle. All prizes must be claimed within two (2) months of the draw date, namely Wednesday, June 3, 2020.
The following prizes will be available to be won (collectively the “Prizes” and individually the “Prize”):
4.1 Grand Prize: Dinner for Two Anywhere in the World, worth a total maximum value of $4,000, which includes:
One trip, including coach class round-trip airfare for two originating from any airport of the Winner’s choice within the United States of America (the “Originating City”) to a major airport of a domestic or international city of the Winner’s choice (the “Destination City”); hotel or cruise cabin accommodations for up to five nights, at a hotel or cruise line of the Winner’s choice. Total value of air travel and accommodations must not exceed $3,800, including all applicable taxes. All travel arrangements must be booked through Bitbythetravelbug, NEED’s designated representative who has partially sponsored this Prize. Also included is a $200 gift card to cover the cost of dinner for two at a restaurant of their choice in the Destination City. The total value for the Grand Prize shall be a maximum of $4,000.

5.TICKET PRICE
Ticket price is $25 each. The maximum number of tickets available for sale will be 1,500. Tickets will be sold in advance of the draw. There is no limit on the number of tickets an entrant may purchase.
6.PRIZE CLAIM
To claim a Prize, the selected entrant must meet, in person, with a NEED representative at a mutually agreed upon location no later than Wednesday, June 3, 2020 at 5pm (the “Prize Claim Deadline”). In order to claim a Prize, the selected entrant will be required provide to NEED a completed W-9 form including social security number, a clear and readable photocopy of government-issued identification (such as a driver’s license or passport), and the selected entrant will be required to sign a standard declaration and release form, confirming: 1) compliance with the contest rules; 2) acceptance of the Prizes(s) awarded; and 3) release NEED and the Prize sponsors (the “Sponsors”) and each of their employees, directors, officers, suppliers, agents, sponsors, affiliates, representatives, advertising media buying and promotional agencies (the “Releasees”) from any and all loss, harm, liability, damage, and expense arising out of participation in the Raffle, participation in any Raffle-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom. Failure to comply will result in forfeiture of the Prize(s). The Winner represents and warrants to NEED that all information submitted with respect to the receipt of the Prize is complete and accurate.
Once these requirements have been fulfilled, the selected entrant shall then be declared the “Winner”. Failure to sign and return said documents in a timely fashion (within 24 hours upon receipt of the release) or if Prize(s) are returned non-deliverable, may result in Prize forfeiture and selection of another entrant.

All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
7.9Language Discrepancy
In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest-related materials, including but not limited to the ticket, or television, print or online advertising, the terms and conditions of the Contest Rules shall prevail, govern, and control.

- This travel package is intended for two travelers; the Winner and one guest.
- Should the Winner choose to upgrade to a higher class of travel service, stay longer, add any other passengers, etc., any and all additional expenses (beyond the allowable $4,000 maximum), shall be the Winner’s sole responsibility.
- There are no “black-out” periods; travel dates shall be chosen strictly based on availability of flights and keeping charges within the allowable amount.

- Ground transportation to and from the airports of the Originating City and Destination City shall be the responsibility of the Winner.
- Bitbythetravelbug must receive no less than a one-month notice prior to the travel dates and be provided with the top three date preferences.
- Travel must be completed within 18 months of the draw date, namely September 3, 2021.
- Once airline and/or hotel/cruise reservations are ticketed and/or paid for, the Winner is solely responsible for charges associated with any changes or for any cancellation penalties, according to the terms of the travel arrangements and/or airline/hotel.
- Should the air travel and accommodations total less than the allowable total value of $3,800, the Winner is not entitled to the difference between the stated and actual value, and no cash shall be rendered for this difference.
- The Winner and his/her traveling companion must comply with any customs and immigration requirements and most possess all required travel documentation prior to departure, including but not limited to passports and visas if applicable.
- The flight is governed by the applicable by-laws, regulations and international conventions, as well as the terms and conditions of the selected airline. Other restrictions may apply.

7.RULES OF DRAW
7.1Eligibility
- To be eligible for this Raffle or any Prize, an individual must be of 18 years of age or older.
- NEED volunteers, board members, and immediate families of volunteers and board members are not eligible to participate in this Raffle and win any Prize. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren, and any other person residing within the same household.
- Check or money order used for the purchase of the ticket(s) must be made payable to NEED. If an entrant’s check is dishonored by the bank, the entry will be declared invalid unless full payment is received and cleared prior to the draw.
7.2Winner Selection
- The Prizes shall be drawn in the following order: (1) Third Prize; (2) Second Prize; and (3) Grand Prize.
- NEED shall be responsible for awarding the Prize and making all reasonable efforts to contact the selected entrants.
- The paper stubs from the draw container and unsold tickets shall be secured or placed in safekeeping for a period of twelve (12) months following the draw date, namely April 3, 2021. If one or more of the Prizes are not claimed by the Prize Claim Deadline, it/they will be disqualified and another entrant will be drawn for that Prize.
- If, as a result of an error relating to the entry process, drawing or any other aspect of the Raffle, there are more selected entrants than contemplated in the Contest Rules, there will be a random draw amongst all eligible Prize claimants after the Raffle’s closing date to award the correct number of Prizes.
- Prizes shall be accepted by selected entrant and in the process outlined herein. Once declared the “Winner”, he/she may transfer any and all of the Prize(s) won at his/her discretion to an eligible person. Prizes are not transferable to NEED volunteers or board members or any members of their immediate family.
- NEED shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to NEED for the purpose of the Raffle must be truthful, complete, accurate, and in no way misleading. NEED reserves the right, in its sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
- The odds of being selected depend on the total number of eligible entries accumulated for the draws.
- The paper stubs from the draw container shall become the sole property of NEED and will not be returned.
7.3Privacy/Use of Personal Information
- The personal information collected in the course of the Raffle will be used for the purposes of identifying selected Prize entrants and administering the Prizes.
- By accepting the Prize, the Winner agrees to the use of his/her name, address, photography, videotape, voice, signature, and any likeness for advertising or publicity purposes and to the use of statement made by or attributed to the Winner, provided same are true, relating to NEED, and any and all rights to said use without further compensation, except where prohibited by law.
7.4Indemnification by Entrant

7.5Limitation of Liability
By participating in this Raffle, entrants agree that:
- NEED or any of the Sponsors of the Prizes are not responsible for any incorrect or inaccurate information associated with or utilized in the Raffle or by any technical or human error which may occur in the administration of the Raffle. NEED or any of the Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.
- NEED assumes no responsibility for late, incomplete, damaged, lost, delayed, stolen, destroyed or misdirected entry stubs. All Prize claim information is subject to verification and will be void if not obtained through legitimate channels, or if not original, or if illegible, altered, forged, garbled, defaced, mutilated, mechanically or electronically reproduced or tampered with in any way, or if the ticket(s) contain(s) printing or production errors or if not obtained in accordance with these Rules.
- If the Raffle is interfered with, or it is impractical to conduct or continue to conduct, in whole or in part, as a result of fire, explosion, power failure, acts of God, civil commotion and/or labor unrest, including but not limited to strikes, slow-downs, lock-outs, picketing or boycotts, NEED and their respective officers, directors, and volunteers shall be released from any and all responsibility and/or liability arising from such interference or impracticability and NEED shall have the option, at its sole discretion, to cancel, extend or reschedule the Raffle without liability.
7.6Conduct
By entering this Raffle, entrants agree to be bound by the Contest Rules and decisions of NEED or the Sponsors, which decisions shall be final and binding in all matters related to this Raffle. NEED reserves the right to declare any entry void and award the Prize to the next drawn entrant if a selected entrant is found to be: (a) violating the Contest Rules, (b) tampering or attempting to tamper with the entry process or the operation of the Contest, and/or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
7.7Law
- This Raffle is subject to all federal laws of the United States and state laws of the Commonwealth of Massachusetts.
- All times stated are Eastern Time Zone times and all values are in United States dollars.
- The Winner will receive a W-2G form from NEED, and the value of the Prize will be treated as ordinary income to the Winner for federal and state income tax purposes. The Winner may be required to pre-pay a portion of the tax liability prior to receiving the Prize. If the Winner is outside the U.S., the rate of tax is 30%.
- The Internal Revenue Service (“IRS”) takes the position that no portion of the ticket price will qualify as a charitable contribution for federal income tax purposes.
- Raffle tickets may not be deposited in the federal mail; doing so is a violation of federal law and may lead to criminal penalties.
7.8Intellectual Property
All intellectual property, including but not limited to trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by NEED, the Sponsors and/or their affiliates.
